Terms of Use and Sale / Legal Notice

In accordance with Article 10 of Spain’s Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, we inform you that the website www.aprendeguitarra.es (hereinafter, “the Website”) is owned by Pedro José Vázquez Martín (hereinafter, “the Administrator”).

Users

Any person browsing the Website is considered a User. Accessing or using any page or section implies acceptance of these Terms and Conditions. When a User purchases products or services, the sales policies described in this document will also apply.

Use of the Website

All content (graphic, textual, multimedia information, photographs, etc.) on this Website is the property of the Administrator and protected by national and international copyright laws. The User assumes responsibility for their use of the Website and agrees not to use it for unlawful activities or activities contrary to morality, nor to disseminate racist, xenophobic, pornographic content, content that glorifies terrorism, or content that violates human rights. The User also undertakes not to introduce viruses or other logical systems that may cause damage, nor to attempt to access other Users’ accounts.

Privacy Policy

The Administrator guarantees the proper handling of Users’ personal data. Under Spain’s Organic Law 15/1999 on the Protection of Personal Data, Users may exercise their rights to access, rectify, cancel or oppose their personal data by contacting hola@aprendeguitarra.es. Each data collection form will specify how the data will be processed and the purpose of the file. The Administrator will not share data with third parties unless required by law.

Intellectual Property

The Administrator owns the intellectual and industrial property rights to the Website and all its elements. Reproduction, distribution or public communication of the content is prohibited without express authorization. Users may view and store the content solely for personal and private use. Commercial use is strictly forbidden.

Disclaimer of Warranties and Liability

The Administrator has adopted the technological measures necessary to prevent damages arising from the use of the Website, such as errors, unavailability or transmission of viruses. However, they are not liable for any failures caused by improper use by third parties. Users must refrain from circumventing security devices installed on the Website.

Modifications

The Administrator reserves the right to modify, without prior notice, the presentation, configuration and content of the Website, as well as the conditions of use, whenever deemed appropriate. These modifications will take effect once published on the Website.

Right of Exclusion

The Administrator reserves the right to deny or withdraw access to the Website to Users who violate these Terms and Conditions, without prior notice.


Sales Policy

Purchases and subscriptions are made electronically via secure external payment platforms (PayPal and Stripe) or credit card. Once the product or service is purchased, the User will have access to the contracted content. The digital content is for personal use and may not be reproduced, distributed or resold in any format. Users must have a high-speed Internet connection to access the content.

Subscription, Payment and Security Policy

By purchasing a subscription, the User authorizes a recurring monthly or annual payment (depending on the chosen plan) processed automatically through PayPal or Stripe. These platforms comply with the highest security standards; for example, Stripe is certified as a PCI Level 1 Service Provider, and PayPal uses encryption technologies and TLS protocols to protect information.

The Administrator does not store sensitive payment data; the entire transaction is handled securely on the PayPal and Stripe servers.

Cancelling the subscription is solely the User’s responsibility. For subscriptions through PayPal, the User must log in to their PayPal account and cancel the recurring payment agreement. For subscriptions processed via Stripe, the User can manage them from their profile on the Website or request cancellation from the Administrator before the renewal date. Charges will continue until the subscription is cancelled. The Administrator cannot unilaterally cancel payment agreements created in PayPal; any refund or cancellation must be processed by the User from their own account.


Refund Policy and Right of Withdrawal

According to Article 103 of Spain’s Royal Legislative Decree 1/2007 approving the General Law for the Defence of Consumers and Users, there is no right of withdrawal on the supply of digital content not provided on a tangible medium once the User has begun execution with their express consent and acknowledgment that they lose the right of withdrawal. By purchasing online courses, memberships or digital downloads on Aprendeguitarra.es, the User acknowledges and accepts that access to the content is provided immediately upon purchase, thus waiving their right of withdrawal.

No refunds will be accepted for digital products or services once access has been enabled, except in cases of technical error attributable to the platform. In exceptional situations, the Administrator may offer partial refunds or goodwill gestures at their discretion. For physical products, the standard 14‑day right of withdrawal applies, provided the product is not among the legal exceptions and has not been opened or used.

Billing and Tax Declaration

All amounts paid are invoiced and declared in accordance with Spanish tax legislation. Once the relevant tax year is closed, it will not be possible to refund amounts already declared. Any refund request must be made within the current fiscal period.


Modification of the Legal Notice and Duration

The Administrator may modify these policies and conditions at any time without prior notice. Modifications will be effective upon publication on the Website and will remain in force while they are posted.


Legal Actions

The Administrator reserves the right to take civil or criminal action against any User who misuses the Website or breaches these Terms and Conditions. In case of dispute, Spanish law applies, and the parties submit to the jurisdiction of the courts of Huelva (Spain).
